Creator Agreement

This Creator Agreement applies to anyone who uploads or publishes content on Dusk (a “Creator” or content provider). It supplements the Terms of Service. Every Creator accepts this Agreement by checkbox during onboarding — including an express acknowledgment of the age-verification rules below — before their first post, and re-accepts when the Agreement changes. Acceptances are recorded (version, time, IP) in a tamper-evident ledger.

1. Verification and eligibility

You must complete government-ID identity and age verification and be at least 18. You represent that you are who you say you are and that all information is accurate. You may use a public stage name.

2. Your content and warranties

You represent and warrant, for every item you upload, that:

  • you created it and own it, or have full rights to distribute it on Dusk;
  • every person depicted is a verified adult (18+) at the time of creation;
  • every person depicted has given informed, written, documented consent (i) to be depicted in the content, (ii) to its public distribution and its upload to Dusk, and (iii) to its being downloaded, if download functionality is ever offered — Dusk does not currently offer content downloads and content is streamed only;
  • it is original and not sourced from any paywalled, leaked, or third-party platform;
  • it does not infringe any intellectual-property, privacy, or publicity right; and
  • any AI-generated depiction of a real, identifiable person has that person’s verified consent and is disclosed.

3. Age verification and consent records

You are responsible for verifying the identity and age of every person depicted in your content, so that only adults (18+) ever appear. On Dusk that duty is discharged through the platform’s controls: for any person other than yourself appearing in your content, you must ensure they complete government-ID verification and a signed release (appearance and distribution consent) before the content can publish — the publish gate enforces this. You agree that supporting age, identity, and consent documentation for every person depicted is kept on record and will be made available on request to Dusk, its payment processors, acquirers, and the card networks. Consent may be withdrawn; withdrawal removes the affected content from publication.

4. Review and licensing

All content is reviewed before publication and may be rejected or removed. You retain ownership and grant Dusk a worldwide, non-exclusive, royalty-bearing license to host, encode, watermark, display, distribute, and promote your content on and through the Platform for so long as it is published (and as needed for legal retention).

5. Revenue share

Dusk shares a percentage of net advertising and sponsorship revenue with Creators, allocated by validated watch time from age-verified sessions. Creators also receive viewer tips, net of the published, volume-tiered platform fee, and may share in paid-membership revenue. “Net” means after third-party payment-processing costs (the processor’s percentage and per-transaction fees, and any chargeback or refund costs attributable to the transaction), which are deducted before the creator/platform split is applied. Earnings are subject to fraud filtering, minimum payout thresholds, chargeback and clawback adjustments, required tax documentation (e.g., W-9/W-8BEN; 1099/DAC7 reporting), and payout via approved rails. The specific percentages, the tip fee schedule, and payout timing are published in your Creator dashboard and may be updated on notice. Dusk does not guarantee earnings.

6. Prohibited conduct and content

You may not use Dusk for any activity that is illegal or that violates the operating rules and brand standards of the card networks (Visa, Mastercard, and their acquirers) or of Dusk’s payment processors. Without limitation: no uploading of others’ content without rights; no CSAM or non-consensual content of any kind; no content in the prohibited categories listed in Section 3 of the Terms of Service (including bestiality, incest, rape or non-consent themes, sleep/intoxication/hypnosis scenarios, underage or age-play themes, extreme violence, bodily excretions, and prostitution or escorting); no evasion of verification, moderation, or takedowns; and no artificial inflation of watch time. Associated terminology is blocked in titles, tags, and profile text. Violations may result in removal, forfeiture of earnings, account termination, and referral to authorities.

7. Termination and records

You may stop publishing at any time. We may suspend or terminate your Creator status for violations. Statutory age/identity and consent records are retained as required by law even after removal or termination.
